4 休息日、法定假日及有薪年假1 所有外籍家庭佣工,无论来港服务年资长短,均可享有12天法定假日: 1月1日 农历年初一 农历年初二 农历年初三 清明节 劳动节(5丹1日) 端午节 香港特别行政区成立记念日(7月1日) 中秋节翌日 重阳节 国庆日(10月1日) 冬节或圣诞节(由雇主选择) 根的规定,外籍家庭佣工有权享有下列假期: -休息日;

-法定假日;

以及 -有薪年假. -根曜脊陀逗显脊娑,如雇主与佣工续约,佣工必须在新合约生效前,返回其原居地 放取不少於7天的休假,费用由雇主支付. -雇主应妥为保存假期及工资记录,以免日后发生争执. 休息日 雇主应怎样为佣工指定休息日? 雇主应在每7天期间给予外佣最少1天休息日.休息日是连续不少於24小时的期间. 休息日应由雇主指定,并可分为固定性和非固定性.若休息日为非固定性,你必须在每 月开始之前,将休息日的日期通知佣工. 雇主可否要求佣工在休息日工作? 不可以.除非发生不能预见的紧急事故, 雇主不得要求佣工在休息日工作.你若强逼 佣工在休息日工作,即属违反的规定. 不过,若佣工同意,你可另定休息日,代替原来指定的休息日.另定休息日须安排在同一 个月内的原定休息日之前,或在原定休息日的30天内. 佣工在休息日返回住所后, 雇主可否要求他/她工作? 雇主不应强迫佣工在休息日工作.不过,佣工可自愿在休息日工作.
